TERMS AND CONDITIONS

COMPETITIONS

Gracious Bakers (Pty) Ltd online competitions are open only to South African residents over the age of 18 and residing in the Republic of South Africa. Employees of Gracious Bakers (Pty) Ltd are not eligible to enter.

The prize is not exchangeable for cash, and the judges’ decision is final. All Gracious Bakers online competitions are free to enter. However, participants are expected to pay their own costs of connecting to the online sites. Winners of competitions will be notified by e-mail within one week of the closing date of the competition.
If contact cannot be made within one week, the prize will be forfeited. Arrangements will be made per individual winner for the collection of prizes. The competition prizes are clearly specified and specifically stated.

Upon entering any Gracious Bakers online competitions, each applicant agrees to receive marketing information from Gracious Bakers. This information could include, but is not limited to, newsletters, information about the products Gracious Bakers offers, conducting market research, and running competitions and promotions. Winners of the competitions may be displayed on the relevant online sites and social media pages with their name and surname.

These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Gracious Bakers (“Provider”) website located at the domain name www.graciousbakers.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for marketing and other purposes without the consent of the Provider.

ELECTRONIC COMMUNICATIONS
By using this Website or communicating with the Provider by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-COMMERCE AND PRIVACY
The use of any product bought from this Website is at the purchaser’s risk. The purchaser/user indemnifies and holds the Provider harmless against any loss, injury, or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information, credit card details, delivery address, and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is, the delivery address and contact phone number, will be made known to third parties delivering the product. The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic devices used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

CREDIT CARD ACQUIRING AND SECURITY (PETE PLEASE UPDATE THE PAYMENT METHODS)
Yoco and Payfast are developed with the same demands on security and performance as websites used for banking services and share trading. Your account login, personal details, and all money transactions are secured using Secure Socket Layer (SSL) technology with high-security 256-bit encryption. Your sensitive financial information (like credit/debit card details) is never sent to the people you pay! You can send money without sending your financial information. We use 3D Secure to further enhance the security of credit card transactions on PayFast for all high-value transactions.

DELIVERY POLICY
Gracious Bakers delivers to addresses within the borders of South Africa. All deliveries are via courier to a physical address. Gracious Bakers reserves the right to amend our delivery policies, prices, and services without notice. Courier delivery typically takes between 2 to 5 business days, depending on the destination of the order. Deliveries are conducted from Monday to Friday, between 9am and 5pm. Please note that there are no deliveries on weekends or public holidays. Deliveries within the main city center usually require 2 to 5 business days. For remote locations, delivery times may extend up to 7 business days. It is essential that your delivery address is somewhere someone you trust will be present at to receive your order. Any individual at the delivery location can accept the package. To confirm that your order has been delivered, we only need to verify that someone at the delivery address signed for it, not necessarily that you were the one to receive it. Unforeseen events, such as severe weather, road closures, strikes, and similar issues, could delay delivery times. Though this is uncommon, such delays can occur, and therefore a ‘late’ delivery does not qualify for a refund or order cancellation. If your order has not arrived after the estimated delivery times stated above, please reach out to us with your order number so we can look into the issue.

RETURNS / REFUND POLICY
If you find yourself unsatisfied with your purchase for any reason, please reach out to us promptly. Since Gracious Bakers provides consumable items, we are unable to offer a money-back guarantee. Kindly contact us within 2 days of receiving your order and provide images of any damaged items, and we will do our best to reach a fair resolution. Please note that we cannot accept responsibility for products that have been exposed to excessive heat, damaged after delivery, or modified in any way. PAYMENT OPTIONS
Payment may be made via Visa or MasterCard credit cards or by bank transfer into the Provider’s bank account, the details of which will be provided after checkout.

MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY** The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

UPDATING OF THESE TERMS AND CONDITIONS
The Provider reserves the right to change, modify, add to, or remove portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS
The Provider supplies certain information on the Website. Content currently or expected to be displayed on this Website is made available by the Provider, its affiliates and/or subsidiaries, or any other third-party owners of such content. We at Gracious Bakers always strive to provide the cleanest ingredients in a 100% gluten free facility, safe for Celiacs as well. We make use of GMO-Free raw ingredients in our facility, and always strive to eliminate all unnecessary additives, processes and bulking agents. We mill all our own flours and spices in-house, to ensure our ingredients can truly carry a clean label.
